Election Effects, SCOTUS Tariff Spanking: But, No Apology Needed from Dealmaking Law Firms
We progressives feel it: Hope. That's the most powerful motivation force. And the decisive wins by Dems in Tuesday's elections have brought it back. Influential Axios headlines with:
"The resistance revitalized"
Then Axios goes on to say:
"A half-dozen scattered elections did overnight what President
Trump himself couldn't do in 10 months: revitalized the Democratic
resistance, instantly and profoundly."
That's a sea change from where we were last March.
I had grown up in the Hudson County, New Jersey Frank Hague political machine and had worked in Barcelona, Spain during the Franco regime. I sensed resistance was not only useless. It was too dangerous. I witenessed what happened to dissenters.
More recently I exited the Unitarian Chruch because it was leveraging sermon time to pitch resistance. The whole gestalt came across to me as crazy. I even told the minister he was going to be arrested. Plus, with so much economic bad news I needed traditional inspiration. Give me some quotes from the bible.
So, here we are. We are forecasting the collapse of MAGA. That's reinforced by the spanking Trump administration tariffs received in the US Supreme Court oral arguments. To save their own skin GOP heavyweights will turn on Donald Trump, as Dem leaders did on a wounded Joe Biden.
But, that shouldn't translate into another beat-down for large law firms such as Paul, Weiss which cut deals with the administration last spring.Business is in the now. At that time they anticipated that the EO's terms and conditions could put them out of business. Unlike corporations which head for bankruptcy slowly that would happen quickly. The law-firm structure is held together by equity partners. Those would flee the sinking ship when their Profits Per Equity Partner didn't come in. They would rapidly find new homes in firms not on the administration's hit list.
No mea culpa should be expected from the dealmaking law firms. That's because it's too much to expect in the American brand of capitalism for them to have been "heroes" back then. They're in a business. Historically, for example, we have allowed businesses to conduct massive layoffs to save themselves. There aren't the worker protections in some other nations.
Yes, there's a price those dealmaking law firms have to pay for comporting themselves as a business. They surrender the right to declare themselves special institutions in a society. No longer can they pontificate on humanistic issues, for example. Just stick to the business of what's associated with practicing law.
